1. Introduction
These Terms and Conditions (“Terms”) govern the relationship between Core Competency Institute (CCI) and any individual, organisation, client, participant, subscriber, partner, or user who accesses or makes use of CCI’s website, digital platforms, applications, diagnostic tools, consulting services, training programmes, events, publications, resources, and related offerings.
Core Competency Institute is a South African professional development and organisational effectiveness institute providing services in organisational capability development, leadership, culture and communication, competency diagnostics, digital learning solutions, professional development programmes, consulting, and advisory services.
By accessing CCI services, registering for programmes, subscribing to digital platforms, purchasing products, or entering into an engagement with CCI, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
2. Applicable South African Legislation
CCI operates in accordance with applicable South African legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA), the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECT Act), and applicable principles of South African contract law.
These Terms are intended to promote transparency, fairness, responsible service delivery, and the protection of CCI, its clients, users, partners, and intellectual property.
3. Use of CCI Services
Users agree to provide accurate, complete, and current information when engaging with CCI services, including registration information, subscription details, diagnostic assessments, and client onboarding processes.
CCI services may only be used for lawful purposes and in accordance with these Terms. Users may not misuse CCI platforms, attempt unauthorised access, interfere with system operations, compromise security, or use CCI resources for unlawful, fraudulent, or unauthorised commercial purposes.
CCI reserves the right to suspend, restrict, or terminate access to services where a user breaches these Terms, misuses CCI resources, engages in harmful conduct, or acts in a manner that may negatively affect CCI, its users, reputation, or operations.
4. Intellectual Property Protection
All intellectual property developed, owned, created, or provided by CCI remains the exclusive property of Core Competency Institute unless otherwise agreed in writing.
CCI intellectual property includes, but is not limited to:
Users are granted limited access to CCI materials solely for the purpose for which they were provided. No person or organisation may copy, reproduce, modify, reverse engineer, distribute, publish, sell, license, or commercially exploit CCI intellectual property without prior written approval.
Any unauthorised use of CCI intellectual property may result in termination of access and legal action where appropriate.
5. CCI Diagnostics and Assessment Services
CCI Diagnostics provides competency assessments designed to support individual and organisational development, capability improvement, and informed decision-making.
Users acknowledge that diagnostic results:
CCI does not guarantee specific outcomes, including career progression, employee performance improvement, organisational transformation, financial performance, or business results.
Organisations remain responsible for interpreting and applying diagnostic results appropriately. CCI shall not be liable for decisions made by clients, employers, or third parties based on diagnostic information.
6. Digital Platforms and Subscription Services
Where CCI provides access to digital platforms, applications, or subscription services, users receive a limited, non-exclusive, non-transferable licence to access the platform according to the selected subscription package.
Users may not:
CCI reserves the right to suspend or terminate access where there is misuse, non-payment, fraudulent activity, security concerns, or breach of these Terms.
CCI will take reasonable measures to maintain platform availability but does not guarantee uninterrupted access due to maintenance, technical failures, third-party service interruptions, cybersecurity events, or circumstances beyond CCI’s reasonable control.
7. Payments and Fees
All fees payable to CCI will be communicated before services commence and will be subject to applicable quotations, invoices, subscription agreements, registration confirmations, or contracts.
Fees are payable according to agreed payment terms. Where payments are overdue, CCI reserves the right to suspend services, restrict access to digital platforms, cancel bookings, and recover outstanding amounts.
Where services have commenced, clients remain responsible for payment for work completed, resources allocated, and services delivered.
8. Confidentiality
CCI respects the confidentiality of information shared by clients, participants, and stakeholders.
CCI will take reasonable measures to protect confidential information and will only use such information for agreed purposes unless disclosure is required by law.
Clients and users are responsible for protecting confidential information, materials, methodologies, and resources provided by CCI.
9. Limitation of Liability and Disclaimer
CCI provides professional services with reasonable skill, care, and expertise. However, CCI does not guarantee specific outcomes from participation in its programmes, consulting engagements, diagnostic services, or digital platforms.
To the maximum extent permitted by South African law, CCI shall not be liable for any direct, indirect, incidental, consequential, or financial losses arising from:

Where liability cannot legally be excluded, CCI’s liability shall be limited to the value of the specific service fees paid by the client giving rise to the claim.

Clients and users agree to indemnify and hold CCI harmless against claims, losses, damages, costs, or liabilities arising from:

CCI shall not be liable for failure or delay in performing its obligations where such failure results from circumstances beyond its reasonable control, including natural disasters, government restrictions, cyber incidents, internet failures, third-party service failures, or other unforeseen events.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa.
CCI encourages parties to resolve disputes through good-faith discussions. Where disputes cannot be resolved amicably, the matter may be referred to appropriate dispute resolution mechanisms or courts with jurisdiction in South Africa.
